These Terms and Conditions constitute the
entire agreement between Upstairs Downstairs Domestic Recruitment (“the Agent”)
and the employer client (“the Principal”)
1The Agent cannot proceed with formal
arrangements of placements until the completed registration forms have been
received.
2The Agent acts as an introduction
and booking agent and does not either directly or indirectly employ staff.
Staff are always employed by the Principal (except where they elect to be self
employed i.e. a maternity nurse). Staff shall be under the supervision,
direction and control of the Principal.
3The Agent shall be under no
liability whatsoever to the employer for any death or injury caused to or
sustained by any person nor for any loss or damage, expense, claim, damage,
delay or behaviour caused directly or indirectly by the introduction or
engagement or the acts or omissions of the applicant, nor as to the medical
fitness of the applicant. We strongly recommend that the Principal has the appropriate
insurance cover.
4The Agent will strive to ensure a
suitable match is made for the vacancy. The Principal must satisfy her or himself of the suitability of the
applicant for the position and check references and certificates personally.
The final responsibility for any decision to employ the applicant rests with
the Principal.
5It is the responsibility of the
Principal to pay the employees tax and national insurance contributions and to
provide a payslip detailing deductions for each day worked.
6The Agent must be notified
immediately when a suitable person is engaged and informed of the commencement
date and length of stay if appropriate. Any Principal who engages the services
of a person originally introduced by this Agent, having previously declined
that person’s service, will be liable for the appropriate fee.
7Agent fees should be submitted
within 14 days of the invoice date. Failure to do so will result in a 10%
surcharge for each calendar month delay in settling your account. Non payment
of fees will result in legal action being taken and the withdrawal of the
introduced employee.
8It is suggested that a four week
trial period be enforced when engaging a person. This will enable both parties
to ensure they are happy.If the
employment is terminated within this period a refund as
a.Following happens then these terms
will apply:
i.Terminated within 2 weeks50% refund
ii.Terminated within 4 weeks25% refund
9The Agent must be informed in
writing immediately of the reason for the termination.
10Introductions are strictly
confidential. The passing on of an introduction to another employer that
results in engagement renders the Principal liable to pay the Agents fees in
full.
11It is the responsibility of the
Principal to agree, at the time of the interview, the duties required of the
employee, salary, time off, holiday and period of notice. You are legally
required to give these details to the employee within the first 12 weeks of
employment. You are advised to agree insurance cover for the employee and for
any vehicles that may be used by the employee and whether the contract is for
an indefinite or fixed period of time.
